In the name of God Amen I Joseph Swindell of Tideswell in the County of Derby miner being weak in
body but of sound and disposing mind and memory (praised be to God) Do Make Publish and Declare this my last
will and testament in manner and form following, that is to say, First I will that all my just Debts then
Legacies herein after by me Given and Bequeathed my Funeral Expenses the Charges of proving and all other
Cherges attending the Execution of this my will be paid Discharged and satisfyed by my Executors herein after
named by and out of my personal Estate; Also I Give and Devise all my messuages Buildings Lands
Tenements and Hereditaments situate standing lying and being at Tideswell aforesaid or elsewhere in the
said County of Derby unto my nephew Job Swindell of Tideswell aforesaid miner his Heirs and assigns
for ever. Also I Give and Devise unto my said nephew Job Swindell Eight Twenty fourths of a certain Grove
or Lead Mine lying within the Liberty of Little Hucklow in the said County of Derby commony called by the
name of Mock Grove his heirs and assigns for ever. Also I Give and Devise unto my nephew Samuel
Swindell of Tideswell aforesaid miner four Twenty Fourths of the said Grove or Lead Mine lying within
the Liberty of Little Hucklow aforesaid commonly called Mock Grove his Heirs and Assigns for ever. Also
I Give and Devise all other my Lead Mines and parts and shares of Lead Mines within the Liberty of the
Hundred of High peak or elsewhere in the said County of Derby unto my said two nephews Job Swindell and
Samuel Swindell their Heirs and assigns for ever as Tenents in Common and not as joint tenents. Also
I Give and bequeath unto my said nephew Samuel Swindell the sum of Sixty pounds Sterling to be paid him
by my said Exors herin after named within Twelve months next after my decease by and out of my
personal estate. Also I Give and Bequeath unto my niece Margaret the wife of John Walton the
younger of Tideswell aforesaid miner the sum of Thirty pounds Sterling to be paid her by my said Executors
within Twelve months next after my decease by and out of my personal Estate. Also I Give and Bequeath unto my niece
Anne wife of William Barber of Tideswell aforesaid miner the sum of Thirty pounds Sterling to be paid her
by my said Executors within Twelve months next after my decease by and out of my personal Estate; Also I Give
and Bequeath unto my niece Ann Howson of Tideswell aforesaid Spinster the sum of Sixty pounds sterling to be
paid her by my said Executors within Twelve months next after my Decease by and out of my personal Estate
Also I Give and Bequeath unto my nephew Thomas Howson of Tideswell aforesaid miner the sum
of Thirty pounds Sterling to be paid him by my said Executors within Twelve months next after my Decease
by and out of my personal Estate; Also I Give and Bequeath unto my said nephew Thomas Howson
all my wearing apparel; Also I Give and Bequeath unto my nephew Robert Doson of Tideswell
aforesaid Cordwainer the sum of Seven pounds and Tenn Shillings Sterling to be paid him by my said
Executors within Twelve months next after my Decease by and out of my personal Estate; Also I Give
unto John Joseph and Anne Hill Three Children of John Hill of Tideswell aforesaid miner
by Margaret his wife the sum of seven pounds and ten shillings apiece to be paid them by my
said Extors when they shall severally and respectively attain their several and respective ages of Twenty
one years by and out of my personal Estate, And my will and mind is thatin Case any of the said Three
Children shall depart this life before such timeas the part or portion of him her or them so dying shall
become payable that then and in such Case the aprt or portion of him her or them so dying shall go and be
Equally divided amongst the survivors and survivor of them share and share alike, if more than one, and to be paid
to be such survivors or survivor at the time aforesaid. Also I Give and Bequeath unto John Thomas and Joseph
Middleton the Three sons of John Middleton of Tideswell aforesaid miner by Ruth his wife the sum of Tenn
pounds Sterling apiece to be paid them by my said executors when they shall severally and respectively attain
their severall and respective ages of Twenty One years by and out of my personal Estate And my will and mind is
that in Case any of the Three sons of the said John Middleton shall depart this life before such time as the
part or portion of him or them so dying shall become payable that then and in such Case the part or portion of him
or them so dying shall go and be equally devided amongst the survivors or survivor of them share and share
alike if more than one and to be paid to such survivors or survivor at the time aforesaid, And my further
will is that in case the said several legacys or sums of money herein before Given and Bequeathed to my
several Legatees herein before named in manner as aforesaid by reason or on account of any Debt or Debts due
and owing or hereafter to grow due and owing to my personal Estate or by any other Losses or misfortunes
whatsoever whereby my said personal Estate shall prove Insufficient or deficiant to answer and pay to my said
several Legatees or any of them their respective Legacys or sums of money at the Time and in manner
herein before directed and appointed for payment thereof as aforesaid that then and in such Case, but not
otherwise, I do hereby order direct and appoint that all Loss or Losses so happening to my said personal
Estate in manner as aforesaid shall be born sustained and allowed by all my said several legatees in
proportion to their several and respective legacys or sums of money herein before by me Given and Bequeathed
anything in this will contained to the Contrary thereof. And lastly I Give and Bequeath all the Rest
[residue] and remainder of my Goods Cattle Chattels, plate, ready money, money at Interest and upon securitys
Bonds, Creditts and other my personal estate and effects whatsoever or wheresoever unto my said nephew
Job Swindell, And I do heeby nominate and appoint my said nephew Job Swindell and William Barber
executors jointly of this my last will and testament and I do hereby revoke and make void all former and
other wills by me at any time herebefore made. In witness whereof I the said Testator Joseph Swindell have to
this my last will and testamentwrote on two sheets of paper annext together. To the first sheet thereof
put my Hand and to the last sheet thereof my Hand and seal this Twenty Fifth day of April In the
year of our Lord one Thousand Seven Hundred and Sixty Seven.

Samuel Swindell, miner of Tideswell, 1803/06

In the name of God Amen I Samuel Swindell of Tideswell
in the County of Derby, Miner, being weak in body but of sound
and disposing mind, memory, and understanding (praised be
God) do make, publish, and declare this my last will and
testament in manner and form following; (that is to say)
First I will order and direct that my just debts, funeral charges,
and the expenses of the robate of this my will be first paid off
and discharged by my Executors herein after named as soon as
conveniently can be after my decease. Item I give and devise unto my
two sons Joseph Swindell and Job Swindell to be equally divided
betwixt them share and share alike, all and every my Messuages,
Lands, Tenements, and Hereditaments whatsoever, and wheresoever,
and of what nature, tenure or kind soever, both freehold and copyhold
(the copyhold part thereof having been duly surrendered to the case
of my last will and testament) together with their and every of
their rights, members, privileges, and appurtenances, and of what
nature, tenure or kind soever of which I die possessed of, or
entitled unto either in possession, reversion, remainder, or expectancy,
togerther with their and every of their rights, members, privileges, and
appurtenances, and also all and singulr my Mines and Groves,
share and shares of Mines and Groves whatsoever, and wheresoever
with all and singular the tools, and implements, and things thereunto
severally and respectively belonging To hold all and singular the
hereditaments and premises aforesaid with their and every of their
appurtenances, unto them the said Joseph Swindell and Job Swindell
their heirs and assigns for ever, as tenants in common and not as
joint tenants. Item I give and bequeath unto the said Joseph Swindell
and Job Swindell all and every part of my household goods, and also
all my live stock as sheep, kine; book debts, mortgages, bonds, note and
notes of hand and the money due, or to become due thereon, and also
my other personal astate and effects whatsoever and wheresoever and
of what nature or kind soever; to be equally shared and divided by and
between them (if they shall so think fit and proper) for his and their
own joint and seperate use and benefit; And as I rent a farm under
Mrs Charlton I wish my two sons to enjoy it equally betwixt them
And lastly I do hereby nominate, constitute and appoint my two
sons Joseph Swindell and Job Swindell joint Executors of this my last
will and testament hereby revoking all former and other will and wills
by me heretofore made, and declaring this to be my last; In witness
whereof I the said Samuel Swindell the Testator, have to this my last
will and testament contained in two sheets of paper, to the first sheet
thereof set my hand, and to this second and last sheet thereof set my
hand and seal the twenty second day of October in the year of our Lord
One Thousand eight hundred and three.

Samuel Swindells, farmer & hay and straw dealer of Tideswell, 1863/67

This is the last Will and Testament of me Samuel Swindells of
Tideswell in the County of Derby Farmer Hay and Straw dealer made
and published as follows, that is to say, First I order and direct that all
my just debts funeral expences and the charges of the proving and executing
of this my Will be paid and discharged by my executrix hereinafter named
and appointed as soon as conveniently maybe after my decease and subject
thereto. I dispose of my property as follows. I give and bequeath all and
singular my Household goods and Furniture, Corn, Hay and Straw, Horses,
Cow or Cows, Cattle of any kind or description, Carts and all farming
implements, Linen, Prints, Pictures, Book and other debts, ready money
securities for money, money that I am intituled to from the Oddfellows club
and all other my personal estate and effects whatsoever and wheresoever
unto my dear wife Mary Ann Swindels my sole executrix of this my last will, hereby revoking
and making void all and every former or other will or wills by me at any time
heretofore made, and do declare this to be and contain may last Will and
Testament. In Witness whereof I the said Samuel Swindells the Testator to this
my last Will and Testament have set my hand and seal (by the mark of a
cross) this fifteenth day of September in the Year of our Lord one thousand eight
hundred and sixty three.

Proves at Derby the nineteenth day of July 1867 by the
Oath of Mary Ann Swindells, Widow, the Relict, the
sole executrix to whom administration was granted.
The testator Samuel Swindells was late of Tideswell in the County of
Derby Farmer and Hay and Straw Dealer and died on the twentysixth
day of April 1867, at Tideswell aforesaid.

Mary Ann Swindells, widow of Tideswell, 1867/73

This is the last Will and Testament of me Mary Ann Swindells
of Tideswell in the County of Derby, Widow, of the late Samuel Swindells
of Tideswell deceased, Farmer, Hay and Straw Dealer, made and published , as
follows, that is to say, First I order and direct that all my just debts
funeral Expenses, and the charges of the proving and executing of this my WIll
be paid and discharged by my Executors herinafter named and appointed as
soon as conveniently may be after my decease and subject thereto. I dispose
of my property as follows - I Give and Bequeath all and singular
household, goods, furniture, [.....], Books, Prints, Pictures, Book and
other debts, and all other my Personal Estate and Effects whatsoever and
wheresoever unto and to my Son Joseph Swindells Joiner and Wheelwright
and my Daughter Hannah Drabble wife of Joseph Drabble Labourer
both of Tideswell aforesaid their Executors, Administrators and assigns, to
and for their own sole and seperate use share and share alike, butin case any
dispute shall arise between them my aforesaid Son and Daughter as to the
share or shares of them, or either of them, I do hereby order and direct
my Executors hereinafter named and appointed to sell and dispoae of my
aforesaid Personal Property for the most money either by Public Auction
or private contract than can be obtained for the same, and the money to
arise by such sale to be equally divided between my aforesaid Son
Joseph Swindells and Hannah Drabble. And also I Give and Bequeath
to my Son Joseph Swindells aforesaid and my Daughter Hannah Drabble
aforesaid the money to arise and to which I am entitled to from the
Odd Fellows Club of Tideswell at my decease. And I also Give, bequeath
and devise all that my freehold House, Barn, Stable, Cowhouse, and
all other the Premises situate, standing and being in the Township and
Parish of Tideswell aforesaid in the County of Derby aforesaid commonly
called or known by the name of the Cliff, with the respective
appurtenances thereunto belonging unto and to my Executors hereinafter
named and appointed in trust, to sell and dispose of my said freehld
Property for the most money that can be obtained for the same either by public Auction
or private contract and the money to arise from such sale, (and if any
surplus, residue or remainder after my just debts be paid) to be equally
divided amongst my Son Joseph Swindells aforesaid and my Daughter
Hannah Drabble aforesaid and my son Job Swindells of Tideswell aforesaid
Hay and Straw Dealer their Executors, Administrators and assings. And
Lastly I hereby nominate Constitute and appoint my Son Joseph
Swindells Joiner and Wheelwright of Tideswell and Robert Bradwell
of Sheffield Yeoman my Executors of this my last Will hereby revoking and
making void all and every former and other Will or Wills by me at
any time heretofore made and do declare this to be and contain my last Will
and Testament. In Witness whereof I the said Mary Ann Swindells
the Testatrix to this my last Will and Testament have set my hand
and Seal this fourteenth day of August in the year of Our Lord One
thousand eight hundred and sixty seven

Proved at Derby the 30th day of May 1873 by the Oath
of Joseph Swindell (in the Will written Swindells) the son,
one of the Executors to whom Administration was granted;
Powere reserved to Robert Bradwell the other Executor.
The Testatrix Mary Ann Swindell was late of Tideswell in the County
of Derby, Widow, and died on the 8th day of September 1872, at Tideswell
aforesaid.

Joseph Swindell, farmer and coal dealer of Tideswell, 1874

This is the last Will and Testament of me Joseph Swindell
of Tideswell in the County of Derby Farmer and Coal Dealer. First I order
and direct that all my just debts funeral and testamentory expenses should
be paid and discharged by my Executors hereinafter named as soon as conveniently
may be after my decease, out of my personal estate and effects. And I give and
devise all my Real and personal property whatsoever and wheresoever and of what
kind soever unto my dear wife Frances Swindell for her own use and benefit for
and during the term of her natural life and from and immediately after her
death, Then I order and direct that all my Property Estate and Effects should be
disposed of in manner following namely, it is my Will and Pleasure, that
all those my four cottages or dwellinghouses with their gardens rights and
appurtenances situate and being at the south end of the Town of Tideswell aforesaid
and commonly called or known by the name of the Lodge shall be divided
between Thomas Bennet the Grandson of my said wife Frances Swindell
and son of William Bennet of Tideswell aforesaid Weaver, and my sister
Emmet Longson Wife of Joseph Longson with a power of appointment during
their lifetime in case of neccesity and in default thereof to the child or children
of each their heirs and assigns for ever as follows namely the two standing
northwards or nearest to the Town of Tideswell with the gardens belonging to
the same and their appurtenances unto the said Thomas Bennet. And the other
two standing southwards or further from the town of Tideswell with the gardens
belonging to the same and their appurtenances unto my said sister Emmet
Longson wife of Joseph Longson. And as to all the rest and remainder of my
Property Estate and Effects not herinafter specially mentioned and bequeathed
and comprehending my three closes or parcels of land known by the name of the
Lodge aforesaid and also my other close or parcel of land situate on Tideswell
Moor all which were lately in my own occupation, but are now in the
occupation of Thomas Needham of Tideswell aforesaid as tenant from year to
year and also all my household goods and furniture money out at Interest, Bank
and oter debts owing to me at the time of my decease and all other matters and
things whatsoever not hereinafter enumerated and of which I have a disposing
power. I order and direct my Executors or their survivors  Executors or representatives
or each of them as the ase may be to sell and absolutely dispose of the same,
either by Public auction or by private contract as to them or him shall seem
best and for the best price and most money that can be obtained and after such
sale or sales the proceeds thereof shall be collected into one entire sum and
afterwards divided or distributed as follows, namely forty pounds to my Nephew
Joseph Swindell the son of my late brother Samuel Swindell, the like sum of
forty pounds to my Nephew Samuel Schofield of Heaton Norris in the County
of Lancaster and son of my late sister Martha the like sum of forty pounds
to my Nephew John Hillkirk of Wakefield in the County of York and son of
my late sister Sarah Hillkirk and twenty pounds to my brother in law Joseph
Longson as some recompence for personal services long rendered to me, and the
surplus or remainder if any I order and direct shall be divided equally between
the said Thomas bennet and the said Emmet Longson. And I hereby nominate
and appoint my friends Joseph Gilbert of Tideswell Shopkeeper and Durham
Wragg of the [Quarters] in the parish of Hope Farmer to be Executors of this
my Will and his or their receipt shall be a sufficient discharge to the Purchaser
or the Purchasers of any Land matter or thing sold by him or them under this
my Will and such purchaser or purchasers shall not be obliged to enquire into
the legality, propriety or impropriety of any such sale or sales and revoking
all other Wills or Will heretofore made by me I the said Joseph Swindell the
Testator do hereby declare this to be my last Will and Testament this fifteenth
day of August one thousand eight hundred and seventy four as witness the
mark of my hand
