In the name of God Ame The Eleaventh day of March the in the year of our Lord God according to Ye English [??????] One thousand six hundred Fiftie and Five I Richard Dale of Flagg in the county of Derby, gentleman sicke and deseased in Bodie but sound and perfect in memory thanks be given to Almighty God therefore doe ordaine Constitute and make this my last will and Testament in manner & forme following. First I Commit my soule to Almighty God my Creator and to Jesus Christ my redeemer by whose merits I trust to have eternal life. And my Bodie to be buried in ye Chancell of the Chappell of Chelmorton in ye place where my Ancestors have formerly bine buried. [????] as concerning my worldlie estate I dispose as following. First I give and bequeath unto Dorothie my wife All my household goods which she now hath at Tiddeswell. And likewise those my two kyne which she hath at Tiddeswell aforesaid in full satisfaction and discharge of the Third part of all my personall estate. And I charge my Executors hereafter named that they be [???????], That she have Tenne pounds a yeare payd unto her according to the [Terms] of a certain deed which I made unto William Wayne Clerk and Robert Daken yeoman for her jointure before I married her. Item I give and bequeath all my messuags Cottages howses Edifices Lands Tenements & hereditaments whatsoever with their Appertnancs unto George Dale my sonne and to his heirs and Assignes forever. Item I give and bequeath unto everie servant which dwelleth with me at ye time of my decease the summe of Tenne shillings Item I give & bequeath unto the Poore of Flagge the summe of three pounds six shillings and eight pence of Currant English monie. Item I give and bequeath to ye repaire of the Chappell & Bells of Chelmorton Three Pounds Six shillings & eigt pence of Currant English monie Item I give & bequeath all ye rest of my goods Cattles & Chattles unbequeathed or not formerlie given to ye said George Dale and Robt Daken equallie to be divided betwixt them. Item I ordaine constitute & make the said George Dale & the said Robt Daken my Lawfull Executors to this my last will & Testament hopeing they will performe ye same according to the trust in them reposed & the true meaning of this my Last will and Testament. To whom was granted Administracon of all of Singuler the goods Chattles and Debts of the said deceased. Will dated 7/10/1656 mentions:
In the name of God Amen the eleaventh day of May in the yeare of our Lord God one thousand six hundred fiftie and eight. I George Dale of Flagge in the Countie of Derby gent sick in bodie but of sound & perfect mind and memorie Praise be given to God therefore doe make constitute and declare in writing this my last will and tetament Revoking thereby both in deed and in law All former wills and testaments by me made or which may be supposed by me to have been made And first to commit my soul into the hands of Almighty God my Creator and Jesus Christ my Redeemer through whose mercie I hope to have eternall life And my bodie to the earth from whence it was taken to be buried in the Chappell of Chelmorton And [????ing] the disposall of that of that temporall state which the Lord hath given me I give bequeath and devise the same as Followeth. First I give and bequeath unto Mary my most beloved wife All that household stuffe which I have with her And which was brought to my house from Lichfield about the time of our marriage. Item I give and bequeath unto George Dale my youngest sonne the summe of five hundred pounds of current English money To be paid unto him the said George my youngest sonne when he shall accomplish the age of one and twentie yeares and if he happen so long to live. Item whereas Richard Dale late of Flagg aforesaid deceased father of me the said George Dale did give unto my daughter Anne Dale the summe of three hundred thirtie and three pounds six shillings and eight pence which it is my will and mind that she shall have together also with use and interest as shall growe due for the same. And also I give and bequeath unto her my said daughter Anne Dale so much more as will make the said summe of three hundred thirtie and three pounds six shillings and eight pence and the said use and interest to amount to one thousand pounds, And the same to be paid unto her when she shall accomplish the age of one and twentie years or within six months next after the day of her lawfull marriage whether shall happen the sooner to be. Item I give and bequeath unto my sister Siythe Daken the summe of twentie pounds of Current English money. Item I give and bequeath unto my oldest sonne Thurston Dale all my lande, tenements and hereditaments in Flagge aforesaid with all and singular their and [????] of their appurtenances To have and to hold the same unto him the said Thurston Dale and to his heirs and Assignes for ever. Item I give and bequeath unto my second sonne Robert Dale all my lande, tenements and heredi- taments lying within [Ruinxton] Bentley Offcoate and Underwood knowne by the severall names of Riddings and Riddings meadowse [????????] or [Beesonyarde] together with the house thereupon and one close called the [lunde] meadows with all and singular their appurtenances; And in consideracon and for the satisfying of that money which was left unto him the said Robert by my father Richard Dale late of Flagge deceased It is my will and mind that he shall enter upon and enjoye the said lands tenements and hereditaments immediately from and after my decease To have and to hold the same to him and his heirs and Assignes for ever. Item I give and bequeath unto the said Robert Dale my second sonne All that my close or pasture commonly called or known by the name of Foxholes and also those three meadowse thereunto adjoyning known by the name of Foxholes meadowes with their and everie of their appurtenances from and after the death and decease of Mary my most beloved wife To have and to hold the same as aforesaid to him his heirs and Assignes for ever. And whereas I have before in and by this my last will and testament given and bequeathed unto Thurston Dale my eldest sonne All my lands tenaments and hereditaments in Flagge aforesaid with their and everie of their appurtenances yet notwithstanding the same were formerly bequeathed unto Robert Dale my said second sonne by the last will and testament of Thurston Dale my uncle late of Flagge aforesaid Deceased [??] therefore my said sonne Robert Dale shall suffer the said Thurstan Dale his said brother quickly and practably to have hold occupie possesse and enjoye the said lands tenements and hereditaments in Flagg aforesaid And also will and sufficiently convey and assure the same unto him and his heirs for ever That this is my mind and will. And I do hereby give and bequeath unto the said Robert Dale my second sonne All those my lands tenements and hereditaments in Kniveton knowne by the name of Ridding Parke and Riddings Parke Springe now in the Tenure or occupacon of one Roger Baynbrigge the Asignie for now, But if my said sonne Robert Dale shall refuse so to doe and to make such securitie unto his said brother Thurstan of the said lands and Tenements in Flagge aforesaid Then it is my mind and will And soe hereby give and bequeath the said Ridding Parke and Ridding Parke Springe with all and singular their appurtenances unto my said sonne Thurstan Dale to have and to hold the same unto him the said Thurtan Dale and to his heirs and Assignes for ever. Item it is my will and mind that in consideracon of the aforesaid money left unto the said Robert Dale my sonne by my said father Richard Dale he the said Robert Dale shall also have and enjoy the rents, issues and profits of all such lands Tenements and hereditaments as in this my present will and testament and bequeath unto him To be imployed to and for his best use and behoofe immediatley from and after my decease at the discretion of my Aunt Siyth Dale. Item it is my will and mind that my debts Legacies and funerall expencs paymenys gifts summe or summes of money [Child parts] and [???cons] herein formerley mentioned and given shall be paid and charged out of my goods Cattle and Chattells unbequeathed, and out of my lands, tenements and hereditaments unbequeathed or out of the rents profits and issues thereof by my Executors hereafter named For the paying and discharging whereof I give and bequeath unto the said Thurstan Dale my eldest sonne All the rest of my goods Cattles and Chattells whatsoever unbequeathed All the rest of my lands Tenements and heriditaments, That is to say All my lands tenements and hereditaments lying within Chelmorton aforesaid Hordlowe and Parwidge in the said County of Derby with their and everie of their rights [????????] and appurtenences And all of my lands tenemenats and hereditaments lying within Alstonfield Spout and Stansopp in the County of Stafford with their and everie of their appurtenences To have and to hold all the aforesaid last bequeathed lands tenements hereditaments and premises to him the said Thurstan Dale and to his heires and Assignes forever And I desire my loving Aunt Siyth Dale to be Supervisor and Executrix of this my last will and testament And doe ordaine constitute and make the said Thurstan Dale my eldest sonne and Robert Daken my brother in law my executors to this my last will and testament hoping they will performe the same according to the trust [????sed] in them and true intent and meaning of the same And further it is my will and mind if any doubts contencons strifes or disagreements shall happen to arise By reason of this present will or any thing therein contained That then my loving friends William Barker and Hugh Sheldon the younger shall have power to decide the differences and doubts at their discretions. In the Name of God Amen I Cornelius Dale of Flagg in the County of Derby, Gent, being indifferent well in health and of sound perfect mind memory and understanding. praised be Allmighty God for the Same [???]. this Fifteenth day of June in the year of our Lord one Thousand seven hundred and nineteen make my last Will and Testament in manner Following. I commit my Soul into the hands of God my Creator and my body to the Earth to be buried in [decent manner] hopeing through the Satisfaction and Righteousness of Christ my redeemer to be made partaker of Eternall hapiness, and as for my Estate reall and personall I dispose thereof as followeth [Imp?????] I Will that all my honest and just Debts and Funerall expenses be first paid out of my reall and personall Estate by my Executors herinafter named. Item all my Lead Mines or [????]s or [Veins] of Lead ore or my parts or Shares of Lead Mines and possessions or Moors of Ground whatsoever within the liberty of [Winster] in the County of Derby aforesaid, I give bequeath and devise to my Cozen [Hugh] Sheldon of Monyash, Francis Staley of [Combsberry], and Francis Allwood the younger of Meadowplace Grange, their heirs and assignes in [Ernst] That they and the survivor and survivors of them and the heirs of the longest liver of them may either sell and dispose thereof or keep the same as they shall think most convenient do the intent and purpose that all. Such sume and sumes of money and other benefit and advantage whatsoever that shall or may [behad] raised or made thereof or thereby Shall be by them the said Hugh Sheldon Francis Staley and Francis Allwood applied to and for the [???] benefit and maintenance of Liddia my dear Wife during her life, to be paid her by twenty pounds per Annum by Quarterly payments [(Joint)] five pounds at the end of every Quarter in every year so long as she shall live and to which I have her [?????] of and full Satisfaction and Recompense of all Such Dower [or thirds] as She may or can claime to have on top of all or any part of my Estate whatsoever by the Common Law or otherwise howsoever, and my Will is that what shall remain out of the profitts that shall be made of the said Mines over and above the paying of the said annuity of Twenty pounds a year to my said Wife for her life as aforesaid the same Shall goe and be for the [Dish] or going and paying of all my said honest and Just Debts and if any thing Shall Still remain after the payment of my Said Debts whether it may be the said Mines themselves or any part or parts or Shares of them or any of them or any part of the money and profitts that Shall and may be had and raised by the Sale of the said Mines or any of them or of any profitt or advantage made of them upon any account whatsoever I give and dispose of the same to my Nephew John Dale of the Custom house London Son of my Brother Nathaniel Dale Deceased To hold to my Said Hephew John Dale his heirs Executors Administrators and assignes for ever, but if it shall so chance or happen (which I hope it will not) that my said Mines at Winster or within the Liberty thereof and the profitts to be made and raised out of the same will not be Sufficient but do or Shall fall Short of making good to my said Wife her said annuity of twenty pounds per Annum for her life that then and in Such case I doe hereby charge all my other Mines herein hereafter mentioned with the payment of the said summe of twenty pounds a year to my said dear Wife during her life as aforesaid. Item I give to my Nephew Richard Dale Joyner one twenty fourth part or Share of a mine called Calver Sough with a twenty fourth part or Share of all Moors or possessions of Ground thereunto belonging To hold to him his Heirs and assignes for ever. Item I also give to my Servant Mathew Frost of Calver one twenty fourth part or Share of the said Mine called Calver Sough and I also give to the said Mathew Frost one twenty fourth part or Share of another Mine within Calver aforesaid or Hassop or one of them called the Busks Grove with one twenty fourth part or Share of all Moors of Ground or possessions to the said two Mines belonging To hold to him the said Mathew Frost his Heirs and assignes forever, but my Will and mind is that the said Richard Dale and Mathew Frost Shall not enter upon or be put into the possession of the said Shares of the said two Mines to them by me given and bequeathed as aforesaid till such time as all my said Debts and Funeral Charges shall be fully satisfied contented and paid and which I hereby order be paid and discharged if possible and without loss to my Estate within twelve months next after my decease and also the said Annuity of twenty pounds a year made good or Secured to my said Wife for her life as aforesaid and my further Will and mind is that if my said Mines shall prove good and Rich whereby my said Nephew John Dale one of my Executors herein hereafter naymed can with ease make payment of my said Debts and Funeral ixpences within twelve months next after my decease then I wish my said nephew John Dale to permit my said Nephew Richard Dale and my said servant mathew Frost to confer upon their said shares of my said Mines so by me given and bequeathed to them as aforesaid [immediately] affor my death and from that time to receive the profitts thereof to their own uses Item all the Remainder of my said two mines and possessions and Moors of ground thereunto belonging and also all my other Mines or [?????] or [Veins] of Lead Oare or parts or shares of Mines whatsoever and possessions or Moors of Ground thereunto belonging within the libertys of Hassop Calver Alport Monyash Flagg and Taddington or else where in the Kingdom of Great Brittain and Dominion of Wales and also all my personall Estate whatsoever [and] of any kind and quality soever I give grant devise and bequeath to my said Nephew John Dale and my said Cousin Hugh Sheldon their heirs Executors Administrators and assgnes in [?????] for the paying and discharging of my said Funeral Expenses and all my said honest and just debts now owing or that shall be at the time of my decease be owing to any person or persons whatsoever which shall in the First place and before any of my Legacies be honestly paid and Satisfyed out of my said Mines and personall Estate as aforesaid and after my said Debts and Funeral Expenses Shall be fully paid and satisfyed then my mind and desire is that what shall remain out of my said Mines and personall Estate over and above the payment of my said Debts and Funeral Expenses and the said twenty pounds per Annum made good to my said Wife for her life as aforesaid and the said shares of Mines given to my said Nephew Richard Dale and my said Servant Mathew Frost as aforesaid and then I do hereby give grant devise and bequeath all my aforesaid Mines and the overpluss and Remainder of all my said mines and personall Estate whatsoever to my said Nephew John Dale his Heirs Executors Administrators and assignes for ever and I do hereby constitute make and appoint my said Nephew John Dale and my said Cozin Hugh Sheldon Joynt Executors of this my last Will and Testament desireing they will [see] the same only and honestly performed to the best of their powers both as to the payment of my said Debts and Funeral Expenses and delivering to my said Wife her said Annuity for her life and I request that my said Executors will take care that my Wifes Brother in Law Robert Heathcote never have or enjoy any thing that is mine or receive any part of the said Annuity left to my Wife and I direct that my said Executors shall be allowed their reasonable Charges and Expenses for their trouble and pains in the Execution of the [?????] in this my Will reposed and which it shall and may be lawfull for them from time to time to deduct in Witness whereof The said Cornelius Dale have to this my last Will and Testament contained in two sheets of paper To the first set my hand and to the second my hand and seale the day and year aforesaid Cornelius Dale sealed signed and delivered and by the Testator published and declared to be his last will and testament and attested by us at his request and in his presence Elizabeth Davies her mark Joshua [Danser] Christopher Berry his mark.Probate granted 11/3/1724
